Governor Mwangaza Faces Setback as High Court Upholds Senate Impeachment

Governor Mwangaza’s Removal Confirmed by High Court

Governor Mwangaza has suffered a major setback after the High Court upheld the Senate’s decision to impeach her. The ruling, delivered by Justice Bahati Mwamuye, confirmed that the impeachment process was lawful and procedural. This decision means that unless she secures a stay order, Deputy Governor Isaac Mutuma M’Ethingia is set to take over as Meru Governor.

The court determined that the Senate followed due process in removing Governor Mwangaza. The judge stated that she was given enough opportunity to defend herself against the allegations brought before the Senate. He further ruled that her claims of unfairness and bias in the process did not hold legal weight.

This marks the third time Governor Mwangaza has faced impeachment proceedings. While her first impeachment was handled by a Senate committee, the last two were debated in a plenary session, leading to her final removal. Her repeated impeachment battles have raised concerns about governance and political stability in Meru County.

Court Dismisses Governor Mwangaza’s Claims of Unfairness

Governor Mwangaza had contested the impeachment, arguing that the process was unfair. She claimed that senators were not given adequate time to debate the motion and that the proceedings were chaotic. She also alleged that gender bias played a role in her removal.

However, Justice Mwamuye dismissed these claims. He pointed out that no evidence, including the official Senate Hansard, supported her allegations. The judge further stated that none of the senators had affidavits indicating they were denied sufficient time to discuss the charges.

On the issue of gender bias, the court ruled that neither Governor Mwangaza nor the Federation of Women Lawyers (FIDA), which was an interested party in the case, provided specific evidence proving that her impeachment was influenced by gender-based discrimination. The judge clarified that if such claims had been adequately supported, the court would have had no hesitation in overturning the Senate’s decision.

Mwangaza’s legal team had argued that the process lacked transparency and fairness. However, the court emphasized that procedural fairness had been observed throughout the impeachment process. This ruling strengthens the legal precedent for future impeachment proceedings in the country, ensuring that county leaders are held accountable for their actions.

Senate’s Vote Leads to Governor Mwangaza’s Ouster

The Senate voted overwhelmingly to remove Governor Mwangaza from office. During the impeachment proceedings, 26 senators supported the charge of gross violation of the Constitution and other laws, while 14 abstained and four voted in her favor.

The second charge, which involved gross misconduct, also received 26 votes in favor, two against, and 14 abstentions. Additionally, 27 senators voted to uphold the charge of abuse of office, while one senator opposed it and 14 abstained.

Most of the senators who abstained were members of opposition parties. Senate Speaker Amason Kingi announced the final resolution, stating that in accordance with the Constitution and Senate Standing Orders, Governor Mwangaza had been officially removed from office.

This decision is significant as it underscores the role of the Senate in overseeing county leadership. The voting pattern also highlights political divisions, with some senators opting to abstain rather than take a firm stance on the issue.

Governor Mwangaza’s impeachment was marked by strong political undercurrents. Analysts believe that her removal could be part of broader political realignments in Meru County and beyond. Some argue that her leadership style made her a target for political opponents, while others believe she was genuinely unfit for office.

Implications of Governor Mwangaza’s Removal

With the High Court ruling in favor of her impeachment, the next step depends on whether Governor Mwangaza will appeal the decision. If she fails to secure a stay order from the Court of Appeal, Deputy Governor Isaac Mutuma M’Ethingia will assume the role of Meru Governor.

Governor Mwangaza’s removal sends a strong message about the power of accountability within county governments. It demonstrates that governors are not immune to removal if they fail to adhere to the law and good governance standards.

Meru County residents have expressed mixed reactions to the ruling. Some believe that her removal was necessary for effective governance, while her supporters argue that she was unfairly targeted. The controversy surrounding her leadership and impeachment is likely to shape the political landscape in Meru for years to come.

The ruling also raises questions about the future of women in leadership. While gender bias claims were dismissed in court, Mwangaza’s impeachment may discourage women from seeking top political offices. Women leaders across the country have called for more protective measures to ensure that female politicians are not unfairly targeted.

What Next for Governor Mwangaza?

Governor Mwangaza still has legal options if she wishes to fight her removal. She can appeal to the Court of Appeal and seek an injunction to prevent her deputy from taking over. However, legal experts argue that overturning an impeachment ruling is a difficult task, as courts generally defer to parliamentary processes unless there is clear evidence of illegality.

If Mwangaza fails to overturn the ruling, her political future will remain uncertain. She could contest for office again in the next elections or take a different political path. However, the stigma of impeachment may affect her chances of making a strong political comeback.

The decision also puts Deputy Governor Isaac Mutuma M’Ethingia in the spotlight. As he prepares to assume office, he faces the challenge of uniting a county deeply divided by the impeachment process. His leadership will be closely watched to see if he can restore stability and deliver on the promises made by the county government.
